Hurdles in registering Apartment association under Karnataka Apartment Ownership Act

Hi,

I am a resident/owner of flat in Pariwar Presidency Apartment in Anugrah Layout, Bilekahalli, Bangalore.

We have started the process for Association registration under Karnataka Apartment Ownership Act (KAOA) based on useful infromation available in this website.

Here are few hurdles that we are facing.

No recognition to gated enclaves

In response to a query under the Right to Information , the Bangalore Development Authority and the Bangalore Metropolitan Regional Development Authority (BMRDA) have said that their rules had no provision for a “gated community”. Further, it is also learnt that the local Bruhat Bangalore Mahanagara Palike also does not recognise the concept.

Lacunae in Karnataka Apartment Ownership Act

Right from beginning, there have existed glaring lacunae in the state Acts pertaining to transfer of ownership of common areas and assets of multi-storied apartment complexes. And, the lackadaisical approach of the officialdom to the rectifications of these are putting the rapidly growing community of flat owners to various kinds of hardships.

Should a multi-storied apartment complex association register itself under Societies Act?

A reading of the Karnataka Apartment Ownership Act 1972 (KAOA, otherwise called Act no 17 of 1973 - click here) very clearly brings out the fact that that is what is relevant to multi-storied apartment complexes.
